This Privacy Policy contains details on issues related to his or her privacy when using or when you are using our services or visiting our website, www.endomdhealth.com (collectively, the “Website”). It is intended to inform you of our policies, procedures, and practices regarding the collection, use, maintenance, protection, and disclosure of any information that we may collect from you or your child or that you or your child may provide through the Website.

We believe that your health information should have proper privacy protections, as required by federal and state laws. All collection, use, maintenance, protection, and disclosure of your child’s health information  is governed by 1.)  this Privacy Policy; 2.) our Notice of Privacy Practices, available at www.endomdhealth.com; and 3.) the Supplemental Privacy Practices information discussed in or Master Consent Agreement, available at www.endomdhealth.com. Please review these sources for more information on how we protect your child’s health information and your and your child’s rights under applicable laws.

This Privacy Policy applies to information we collect:

  • on our Website;

  • in email, text, mail, in app messaging, and other electronic messages between you and our Website;

  • through mobile and desktop applications you download from our Website; and

  • telephonically between you and EndoMD Health.

It does not apply to information collected by:

  • us offline or through any other means, including on any other website operated by us or any third-party;

  • any third party, including through any application or content (including advertising) that may link to or be accessible from or on the Website.

Information Collection, Use, and Disclosure

We collect, or may collect, several types of information from and about users of our Website, specifically information:

  • by which you or your child may be personally identified, such as name, postal address, billing address, email address, work address (if applicable), shipping address, e-mail address, telephone numbers (home, and if applicable, work, and mobile), driver’s license number (if applicable), and other government identification numbers (such as social security number), date of birth, credit or debit card number (if applicable, for payment purposes only), insurance carrier membership data, biometric data, sex, race, religion, photos or images of your child, registration information (including login and passwords), and other personal information;

  • that is about you or your child but individually does not identify you or your child, such as traffic data, location data, logs, referring/exit pages, date and time of your visit to our Website or your child’s, error information, clickstream data, and other communication data and the resources that you or your child access and use on the Website; and/or

How We Collect Information About Your Child

We collect Personal Data directly from you when you or your child provide it to us, automatically as you or your child navigate through the Website and from third parties, for example, our business partners.

The information we collect on or through our Website provided by you or your child may include:

  • information that you or your child provides by filling in forms on our Website. This includes information provided at the time of registering to use our Website, completing a questionnaire or form, or requesting further services. We may also ask you or your child for information when you or your child reports a problem with our Website;

  • records and copies of  correspondence (including email addresses), if you or your child contacts us; 

  • responses to forms or surveys that we might ask you or your child to complete; and

  • details of transactions that may be tracked through our Website and of initiation of services. You may be required to provide financial information as part of initiation of services through our Website.

We may also collect information about you or your child, including Personal Data, automatically.  The information we collect automatically may include personally identifiable information or we may maintain it or associate it with personally identifiable information we collect in other ways or receive from third parties. It helps us to improve our Website and to deliver a better and more personalized service by enabling us to:

  • estimate our audience size and usage patterns;

  • verify the location of you or your child to ensure we can provide our services;

  • store information about the preferences of you or your child, allowing us to customize our Website according to individual interests;

  • recognize you or your child when you or your child returns to our Website.

  • We use other third-party analytics tools to help analyse how individuals use the Website, including but not limited to Mixpanel and Iterable. Such third parties may use cookies, application program interfaces, and software development kits in our services to enable them to collect and analyses user and device related data and information on our behalf.  Such third-parties may use cookies to collect information such as how often users visit the Website, what pages they visit, and what other sites they used prior to coming to the Website. We use the information we get to improve our Website and services. These third-parties have their own terms of use and privacy policies that are separate and apart from our own. We do not control these third parties’ tracking technologies or how they may be used and are not responsible for the privacy and security practices or the content, advertising, products, services or other materials made available on or through any such third-party sites.  If you or your child has any questions about an advertisement or other targeted content, you or your child should contact the responsible provider directly.

  • Certain features of the Website use GPS technology to collect real-time information about the location of your device to provide services in the state where you are located. Strictly necessary and functionality cookies are used on our Website to support Website functionality and security. These cookies collect crash analytics and Website activity data, as well as provide security measures.

De-identified information  

We may use de-identified information created by us without restriction. When we use the term “de-identified information,” we mean information that is neither used nor intended to be used to personally identify an individual. 

Children’s Privacy

We are a practice that provides healthcare for children and their parents or guardians. We will collect identifying information with the consent of a parent or guardian. For patients aged 17 and under, we can schedule an intake session through the parent or guardian of the minor client. However, if the patient’s parent or guardian would like to have access to the patient’s information after the intake session, then we need written authorization naming the parent or guardian in the patient’s file.

For users aged 13 and under, we collect a first and last name, date of birth, sex, username, and the email address of that user’s parent or guardian to provide notice to the parent regarding the services.

Our services are available for use by children (under 18 years of age) but children are not authorized to become Members and may not use the services without the supervision and verifiable consent of a parent or legal guardian. If you register as the parent or legal guardian on behalf of a minor, you understand that as part of the services, we will collect the personal information of your child. Your consent is required for the collection, use, and disclosure of your child’s information. We will not collect your child’s personal information unless you consent to our Master Consent Agreement, available at www.endomdhealth.com and by agreeing to this Privacy Policy. However, if you do not give your consent, your child may not use our services. We collect information about the child’s use of the services (as supervised and authorized by a parent or legal guardian), including information sent by the mobile device or computer used by the child (e.g., IP address, unique device identifiers, website usage information, etc.) and information sent by the mobile device(s), and location information.. If we learn that we have collected the personal information of a child under 18 outside the above circumstances, we will take steps to delete the information as soon as possible to the extent permitted by law.

We may use your personal information for the following purposes:

  • To provide our Website and its contents and full functionality to you or your child;

  • For business analytics purposes

  • For our own marketing purposes

  • To provide customer support to you or your child

  • For account and network security purposes

  • To maintain legal and regulatory compliance

This Privacy Policy applies only to information we collect through the Website. When you click on links on the Website you may leave our Website. We are not responsible for the privacy practices of other websites, and we encourage you to read their privacy statements.

Our Website may contain links to other websites that have information we believe may be of interest. We do not endorse these websites. While we try to link only to websites that share our high standards and respect for privacy, we are not responsible for the content of the sites or privacy practices employed by other sites. We encourage you to read the privacy policy of each website you visit that may collect information or ask you or your child to disclose Personal Data. This Privacy Policy does not apply to information collected on external websites that may be linked to or through the Website.

Text Messaging and Email

We may use your telephone number and email address for the purpose of sending you text messages and email to communicate with you, including for purposes such as announcements, service information, and other updates. You may also notify us  of any changes or errors in any Personal Data we have about you or your child to ensure that it is complete, accurate, and as current as possible or to delete Personal Data for you or your child.  We may not accommodate your request to change information if we believe it would violate any law or legal requirement or cause the information to be incorrect.

Data Security

We have implemented measures designed to secure Personal Data from accidental loss and from unauthorized access, use, alteration, and disclosure. The safety and security of Personal Data also depends on you. Where you have chosen a password for the use of our Website, you are responsible for keeping this password confidential. We ask you and your child not to share passwords with anyone. Unfortunately, the transmission of information via the internet is not completely secure. Although we make reasonable efforts to protect Personal Data, we cannot guarantee the security of Personal Data transmitted to our Website. Any transmission of Personal Data is at your own risk.
